Availability of appeal statistics has traditionally been limited to data in the nature of total applicant wins and total applicant losses at the Board. For example, some sources have reported that the rate of examiner reversal is as low as 33%. It is no wonder that patent attorneys, other patent professionals and individual patent applicants have traditionally perceived the appeal process as being fraught with challenges and uncertainty.
