On Friday, October 5, 2012, T5 Labs (plaintiff) recorded a suit against Gaikai (defendant) for patent infringement in the U.S. District Court of Delaware (case no.1:12-cv-01281).

T5 Labs manufactures set top box video games, mobile video games and games streaming. Gaikai is a cloud-based gaming service that allows users to play high-end PC and console games via the cloud and instantly demo games and applications from a webpage or internet-connected device. Gaikai was acquired by Sony on July 12, 2012.

The patent US8203568 involved in this suit is assigned[*] to T5 Labs (source: MaxVal’s Assignment Database). The patent entitled Sharing a graphical processing unit between a plurality of programs was issued on June 19, 2012 and expires[†] on March 03, 2023.

According to the complaint, the defendant’s product cloud-base gaming applications and services, also referred as GPU cloud, infringes the ‘568 patent. This product includes a system and method of sharing a graphic processing unit (GPU) between a plurality of programs.

Great comment on LinkedIn by Brian Case: "This patent is a perfect example of one that should not have been granted: it is essentially time-multiplexing of a processing unit; replace GPU with CPU and you have time-sharing. This patent should never have been granted on the grounds that it is intuitively obvious to a casual observer, let alone one skilled in the art. Sheesh."
