Clio USA, Inc, (CLIO) filed a complaint for a declaratory judgment (DJ) action against Procter & Gamble Company (P&G) on Wednesday, September 12, 2012 in the U.S District Court of New Jersey (case no. 2:12-cv-05711).

According to the complaint, P&G sued Team Technologies, a distributor of CLIO’s whitening dental strips, in July 2012, for infringement. CLIO seeks to have the patents invalidated or a judgment that CLIO’s products do not infringe any claim of P&G’s patents. No similar cases have been filed by CLIO in the past.
