Court Issues Judgment Favoring Apple in Patent Dispute

Case Summary: 
Operating Systems Solutions filed a suit against Apple for patent infringement which alleged that Apple’s OS X operating system infringes a patent relating to fast booting operation. The patent involved in this suit was USRE40092, entitled Method for quickly booting a computer system, issued on Feb 19, 2008 and expiring[1] by May 11, 2018.

The ‘092 patent was a reissue of US6434696, which was originally filed in 1999 by LG Electronics. Afterwards, it changed hands and was reissued is to Protimus Technologies in 2008. It is currently assigned[2] to Operating Systems Solutions (source: MaxVal’s Assignment Database). The complaint said that accused products include MacBook Pro and any Apple product utilizing OS X. Plaintiff sought injunctive relief and any damages as a result of Apple’s alleged infringement.

On Jun 14, plaintiff filed a stipulation of non-infringement, pursuant to which the Court signed off the final judgment on Jun 17, thereby closing the case. Plaintiff lost on all claims as the Judge ordered non-infringement of the patent in favor of Apple. Further details of the verdict are not disclosed.
