Two patent infringement suits were filed separately by Adaptix against Apple and AT&T (3:13-cv-04468) and the other against Apple and Cellco Partnership (3:13-cv-04469) claiming that 2 of their patents were infringed. Both the patents relate to the field of wireless communications and more particularly to multi-cell, multi-subscriber wireless systems using orthogonal frequency division multiplexing (OFDM).
Both the complaints stated that defendants directly/ indirectly infringed claims of the ‘212 and ‘748 patents by manufacturing computerized devices including the iPhone 5s and iPhone 5c, thereby being liable for infringement of the Adaptix patents. 
 
“Defendants’ infringement has caused damage to Adaptix, which infringement and damage will continue unless until they are enjoined”, as pointed out in the complaint. Whereof, Adaptix requested entry of judgment in its favor, a permanent injunction barring the infringement of the patents-in-suit, compensatory damages, pre- and post-judgment interest on damages, as well as attorneys' fees and litigation costs.
 
On Oct 14, plaintiff Adaptix filed a notice of voluntary dismissal for both the cases, pursuant to which the Court granted dismissal without prejudice, thereby closing the cases.
