Merck and Roche Targets Sun and Caraco Over Ganirelix

 

Merck, MSD, Organon  and Roche (”Plaintiffs”) have launched a complaint against Sun Pharmaceutical Industries, Inc. and Caraco Pharmaceutical Laboratories ( “Defendants”) in the U.S District Court of New Jersey on Aug 27, 2012  for patent infringement (case no. 3:12-cv-05374).

 

Organon is the holder of the approved New Drug Application for Ganirelix Acetate Injection. Ganirelex is approved to inhibit premature luteinizing hormone surges in women undergoing controlled ovarian hyperstimulation.

According to the complaint, defendants submitted Abbreviated New Drug Application (No. 20-4246)  to obtain approval from FDA to engage in the commercial manufacture and sale of Ganirelix Acetate for Injection* (source: Maxval’s Patent Marker) that is covered by USPN 5767082 and USPN 6653286 . These patents have not been asserted before.
