On Friday, September 28, 2012, Mission Pharmacal Company (plaintiff) recorded a suit against Puretek Corporation (defendant) in the U.S District Court of Western Texas for patent infringement (case no. 5:12-cv-00920).
Mission Pharmacal is a Texas based company with R&D facilities. They are in the business of manufacturing prescription medications and over-the-counter products in four expanding therapeutic areas of focus: women’s health, urology, pediatrics, and dermatology.PureTek are in the business of manufacturing pharmaceutical, nutritional and personal care products - bulk and private label items for some of the largest retail chains and branded drug companies.
The patent US6521247 involved in this suit is currently assigned* (source: Maxval’s assignment Database) to Mission Pharmacal and titled Dual iron containing nutritional supplement was issued on February 18, 2003 and expires on March 31, 2020+.
According to the complaint, the plaintiff’s patented product is used before, during and after pregnancy to combat iron deficiency - anemia. It is a dual iron nutritional supplement. The defendant’s product Pharma Pure RX PNV OB+DHA is also an iron nutritional supplement that allegedly infringes the patent US6521247.
