Digitech Image Technologies based out of Newport Beach California filed a patent infringement lawsuit against Sony alleging that they violated their patent, which describes a method of allowing the camera to capture, transform or render a digital image. The patent involved in this suit is US6128415, entitled Device profiles for use in a digital image processing system issued on Oct 03, 2000 and expires[i] by Sep 06, 2016. The patent was originally assigned to Polaroid (which brought a lawsuit against Kodak in the year 1986, and eventually Kodak was forced to stop manufacture both the camera and film) and is currently assigned[ii] to Digitech Image (source: MaxVal’s Assignment Database).
The complaint stated that the Sony manufactures products/devices that infringe the method claimed in the ‘415 patent. The accused products were alpha EX-7, alpha NEX-5N, alpha NEX-C3, alpha NEX-F3, alpha a77, alpha a65, alpha a57, alpha a37, Cyber-shot HX200V, Cyber-shot HX30V, Cyber-shot TX66, Cyber-shot W650, Cyber-shot TX200V, Cyber-shot TX20, Cyber-shot HX10V, Cyber-shot H90, Cyber-shot WX150, Cyber-shot WX70, Cyber-shot W690, Cyber-shot W620, Cyber-shot W610 and Cyber-shot WX50. The complaint sought a judgment in favor, permanent injunction, damages, costs and expenses incurred.
The case ended as the parties announced that they have reached an agreement and filed joint stipulation to dismiss the case. Upon consideration, the Court ordered a dismissal with prejudice with no charges imposed on either party. The terms of settlement were not disclosed.
Digitech has also filed suits against Apple, Toshiba, Motorola, Asus Computer and others asserting the same patent.
